Cutting Off the Hand as Punishment for Theft Perpetrators in Indonesia: Gustav Radbruch Perspective

Abstract

This study examines cutting off the hand as a punishment for theft in Qs. Al-Ma’idah (5): 38 and its relevance to the Indonesian legal system from Gustav Radbruch’s perspective. This research applies a normative-juridical method based on library research by integrating Radbruch’s theory of legal objectives, Fazlur Rahman’s double movement hermeneutics, Islamic legal analysis, human rights, and Indonesian positive law. The findings show that cutting off the hand in Islamic criminal law cannot be imposed absolutely on every theft offender, since it requires strict legal conditions, including legal capacity, minimum value of stolen property, proper custody, absence of legal ambiguity, and absence of necessity. In the Indonesian context, this punishment cannot currently be applied because it is not regulated under the old Criminal Code, the new Criminal Code, or Aceh’s Qanun Jinayat, while criminal sanctions must be based on positive law and imposed through an authorized court. Radbruch’s perspective emphasizes that legal certainty, legal utility, and justice must be understood proportionally, with justice as the primary orientation. This study argues that Islamic law is not inherently contrary to human rights, since Islam upholds the protection of life, property, intellect, religion, and human dignity. Therefore, cutting off the hand should be understood as a hudud norm with conceptual validity in Islamic law, while its applicability in Indonesia must comply with the principles of legality, maqāṣid al-syarī‘ah, justice, humanity, and the national legal system.
