Material and Immaterial Justice in Polygamy
An Ethical and Aesthetic Analysis from the Perspective of Islamic Law Philosophy

The practice of polygamy has long been a subject of debate within Islamic family law. Although permitted under certain conditions, the application of justice in polygamy is often limited to material aspects, such as financial support and the allocation of time, whilst emotional and psychological aspects are frequently overlooked. This research aims to analyse justice in polygamy from the perspective of Islamic legal philosophy, with an emphasis on ethical and aesthetic principles. This research employs a qualitative approach to explore the dimensions of material and immaterial justice that are often not given equal attention in the practice of polygamy. The results indicate that whilst material justice is easier to measure and implement, immaterial justice which encompasses emotional and psychological care for the wives is a crucial yet difficult element to apply objectively. Islamic legal philosophy, grounded in ethical and aesthetic principles, offers a more holistic approach to the application of justice that emphasises not only material aspects but also the emotional well-being of the wives. This research suggests the need for regulatory reform regarding polygamy to accommodate both dimensions of justice, in order to realise a more just and harmonious relationship in the practice of polygamy.
